Social Media Contest Terms & Conditions

These terms and conditions govern all social media contests organized and managed by Attana Hotels & Resorts Sdn. Bhd. (“Attana”) and its associated properties and brands (hereinafter referred to as “the Organizer”). The properties and brands under the Organizer’s management include:

By participating in any social media contest organized by the entities and brands listed above, participants agree to comply with these terms and conditions in their entirety, subject to applicable legal and compliance requirements.

1. Eligibility
1.1. The contest is open to individuals aged 18 and above as of the contest commences date.
1.2. Participants must be residents of Malaysia.
1.3. Employees of the Organizer, its affiliates, appointed agencies, and their immediate family members are not eligible to participate.

2. Duration
2.1 All contests will be held within the designated period as specified in the respective contest announcements published on the official social media platforms of the entities and brands listed below (“Contest Period”):

2.2 The Organizer reserves the right, at its sole and absolute discretion, to shorten, extend, reschedule and/or terminate the Contest Period at any time, without prior notice. In the absence of an official announcement of an Extended Period, any redemption requests made after the conclusion of the Contest Period, for any reason whatsoever, shall be deemed void and will not be accepted. Any participation in the Contest during an Extended Period (if applicable) shall be subject to these Terms and Conditions, which shall remain in full force and effect.

3. Contest Mechanics
3.1 The contest mechanics will differ depending on the nature of each specific contest and will be comprehensively outlined in the respective Organizer contest announcements. These announcements will provide all necessary details, including participation instructions, eligibility criteria, judging criteria, and any other relevant information specific to that particular contest. Participants are advised to carefully review the contest rules and guidelines to ensure compliance with the terms and conditions set forth for each contest.
3.2 All participant must be submitted by the deadline specified in the contest announcement. Late submissions will not be considered or accepted under any circumstances.

4. Contest Prizes
4.1 The total number of winners, as well as the range and value of prize(s) for each individual contest, will be explicitly detailed in the official contest announcement by the respective Organizer and Brands.
4.2 The Organiser does not guarantee the availability of non cash-Prizes and the Organiser shall be entitled to replace and/or substitute such prize(s) with any other prize(s) of similar value as determined by the Organiser, its agents or sponsors at its sole discretion.

5. Winner Selection
5.1 The selection of winners will be conducted in accordance with the specific mechanics and criteria detailed in the official announcement of each respective contest by the organizer.
5.2 The organizer reserves the exclusive right to modify, amend, or alter the winner selection process at its sole discretion, including but not limited to the criteria, timing, or any other relevant aspect, without prior notice to participants or the need to provide any justification for such changes.
5.3 Participants are permitted to submit multiple entries for the contest; however, each participant shall only be eligible to win a single prize per contest, irrespective of the number of entries submitted. Multiple prizes will not be awarded to a single participant.
5.4 To be considered eligible for winner selection, participants must ensure that their social media accounts are set to “Public” throughout the entire duration of the Contest Period. Failure to comply with this requirement may result in disqualification from the contest, at the sole discretion of the organizer.

6. Winner Announcement
6.1 The winners will be officially announced on the organizer’s or the respective brand’s official social media platforms no later than fourteen (14) working days following the conclusion of the Contest Period.
6.2 Upon announcement, winners must promptly provide the required details, including but not limited to Full Name, Contact Number, Email address, and Mailing address, by submitting such information via direct message within seventy-two (72) hours from the announcement.
6.3 Failure to submit the requested details within the stipulated seventy-two (72) hour period may result in disqualification of the winner. In such cases, the organizer reserves the right to select an alternative winner at its sole discretion.
6.4 Prizes will be dispatched to the winners through either postal services or electronic correspondence, depending on the nature of the contest and the type of prize. For prizes sent via mail, the mailing address provided by the winners will be used. Once the mailing address has been submitted, it shall be considered final, and no amendments or updates will be accepted. The organizer shall not be held responsible for undelivered prizes resulting from inaccurate, incomplete, or incorrect address details provided by the winners.

7. Copyright, Announcement, Confidentiality and Personal Data Protection
7.1 By participating into this Contest, the Contestant and/or Winner hereby grant the organizer perpetual and non-exclusive rights including consent to broadcast the names, pictures and/or images and/or video and/or display any matter related to the participant and/or winner for publicity, advertising, trade or promotional purposes in any media without prior notice to the participant or the Winner. The Participant and/or Winner are not entitled to claim any payment in any form, fee or compensation for the use of their images or details in relation to the above.
7.2 The Participant and/or Winner acknowledges, understands, and agrees that their personal details may be shared by the organizer for purposes directly related to the administration and execution of the Contest. Any personal information or data (“Personal Data”) provided by the Participant to the organizer in connection with the Contest shall be treated as confidential, except in relation to activities expressly outlined in the Contest terms. The organizer agrees to take all reasonable and necessary precautions to safeguard the integrity of the Participant’s Personal Data, ensuring its protection against any unauthorized access, loss, damage, or destruction. Furthermore, the organizer commits to complying with the provisions of the Personal Data Protection Act 2010 and any applicable laws regarding the collection, storage, and handling of Personal Data.
7.3 Any Personal Data provided by the Participant to Attana and its management properties or Brands in connection with this Campaign shall be kept confidential and is subject to the Privacy Policy of Attana (for further information on the Privacy Policy of Attana’s group of companies, please visit https://attanahotels.com/privacy-policy/).

8. Rights of the Organizer
8.1 By entering and participating in the contest, participants hereby acknowledge, confirm, and consent to the full understanding of these Terms & Conditions. The organizer expressly reserves the right, at its sole discretion, to modify, amend, or revise these Terms & Conditions without prior notice, and such modifications shall be binding upon participants.
8.2 Participants agree and irrevocably grant the organizer full ownership of all intellectual property rights pertaining to their contest submissions. This includes, but is not limited to, the right to use, adapt, alter, reproduce, publish, or display such entries in any manner deemed appropriate by the organizer, including for advertising, marketing, or promotional purposes, without any obligation to provide compensation or credit to the participant.
8.3 The organizer will not be liable or responsible for any technical failures, system malfunctions, or delays, whether caused by hardware, software, or other technological issues, that may impede or disrupt participation in the contest or the timely notification of winners.
8.4 All prizes are awarded on an “as is” basis, and the organizer makes no representations or warranties, either express or implied, regarding the quality, condition, fitness for a particular purpose, or suitability of the prizes. Participants accept the prizes in their current state and assume all risks associated with their use or enjoyment.

9. Governing Law
The Contest Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of laws principles. By participating in the Contest, both you and the organizer irrevocably submit to the exclusive jurisdiction of the courts of Malaysia. You further waive any objections, whether on the grounds of venue, forum non-conveniens, or any similar jurisdictional challenges, in relation to the venue or forum of any legal proceedings arising from or in connection with the Contest.
